Alabama Laws on Selling Eggs And Produce?

I have been considering starting to sell our eggs and some of the extra produce we have grown. In the fall I am doing a huge garden, and then again next spring and fall, etc.

What are the laws in Alabama about selling eggs and produce out of your back yard? Can I market it, like a website, craigslist ad, maybe even newspaper?

Not looking to make a ton of money or anything, just looking to supplement our income. Do I have to claim that on my taxes??

It's no one's business but yours anyway. It can't be against the law because the Alabama Farm Bulletin has them for sale. Same with produce.

Yeah thats what I was hoping, But I have read on here that some people have actually gotten in trouble for selling eggs without being licensed?

I think in some states you have to have 50 or more birds to have to get a license, but I cant find anything about it for Alabama. I only have 10 hens at the moment.

I am hoping that by the fall we'll be getting 9-10 eggs a day and that my fall veggies will have come in too. I guess I can always claim ignorance?

This is what I found. I take this to mean that I can sell my OWN eggs as long as I didnt get them anywhere else. Or I can sell them for "hatching". Am I right in that?

The provisions of this chapter shall not apply to:

(1) Producers who sell eggs of their own hens' production and who do not sell eggs received or purchased from other sources, unless such a producer elects to come under this chapter by applying for and securing a permit as provided in Section 2-12-4;

(2) Eggs to be used exclusively for hatching purposes; and

(3) Bona fide shipments of eggs in interstate commerce.

Alabama simply requires that you have a label on the eggs stating what size they are (to be determined by weighing a dozen eggs) and your name/address. No other requirements. That is state-wide, not county by county.

I'm in Tennessee, close to the Alabama border and have a few people in AL interested in buying our eggs. Does anyone know about selling eggs from TN in AL? Any info would be greatly appreciated.

My understanding is that if you sell the eggs from home you don't have to do anything but if you sell anyplace else you have to follow state requirements. They would make selling too expensive and time consuming for most small flock owners.

I'm so glad to find this out before going to great expense to sell a few dozen a week. Our hens are cranking out eggs like they are made in machines now even though the days are still short. My main concern was how to grade. Now I'm off to find a roadside sign. Thanks to all who posted on this subject.
